Sponsorship The Sweepstakes “Spain is part of you” (hereinafter the “Sweepstakes”) is organised by the Institute of Tourism of Spain (TURESPAÑA), a public organization under the Spanish Ministry of Energy, Tourism and the Digital Agenda through the Secretary of State for Tourism, with VAT number Q-2829013-H and registered address at Poeta Joan Maragall 41 Madrid (28020), hereinafter, “The Sponsor”. The Spanish Tourist Office in London whose registered office is at whose registered office is at 64 North Row – 6th Floor London, W1K 7DE, will collaborate with The Sponsor in conducting the Sweepstakes. The sweepstakes is regulated by the terms and conditions set out in this document (hereinafter the ‘Terms and Conditions’).
Sweepstakes Registration Period The Sweepstakes Registration Period, during which it will be possible to participate begins on April 18th, 2018 at 12:00 hours and ends on June 15th, 2018 at 12:00 hours both inclusive (Spanish Peninsular Time). To be eligible, entries must be received before the end of the Term.
Geographical Area The geographical area of the Sweepstakes will be the territory of the United Kingdom.
Conditions of participation
4.1 Only individuals of legal age may participate in the Sweepstakes in accordance with the law legislation of the United Kingdom. Participants must be residing in the United Kingdom.
4.2 The Sponsor reserves the right to verify that all participants comply with the conditions of participation during or once the Sweepstakes is finished, and this may be cause for modification of the list of winners. The identity and legal status of participants can be checked through official documents (National Identity Card, passport, driving licence, residence permit, etc.).
4.3 The participation in the Sweepstakes is free. It is not necessary to make any purchases to win the Prize.
4.4 The persons involved in the organisation of the Sweepstakes may not take part in it. Employees of the Sponsor or its affiliates, or first-degree relatives of the employees of those entities may not take part in the Sweepstakes either.
4.5 The express acceptance of these Terms and Conditions is a prerequisite for the participation in the Sweepstakes and, consequently, a prerequisite to obtain the Prize. It is considered that the participant has accepted the Terms and Conditions when he/she registers in accordance with the procedure established in these the Terms and Conditions.
4.6 Failure by any participant to meet the conditions set in the Terms and Conditions shall result in automatic cancellation of such participation. Similarly, any false indication or evidence of false identity, fraud or abuse will result in immediate disqualification and, where appropriate, the obligation to return the prize if it has already been awarded.
4.7 The Sponsor reserves the right to modify, suspend, shorten the Registration Period or cancel the Sweepstakes or draw if there is a reasonable cause for this or if there are not enough participants and to make any necessary decisions regarding the Sweepstakes (unless prohibited by local law). Any suspension, cancellation or modification will be announced in the Sweepstakes webpage.
4.8 The winner of the Sweepstakes authorises the Sponsor to capture and reproduce his/her image by any means (including the image and the name) on the occasion of their winning the Sweepstakes, comprising this authorisation of the collection, use, reproduction, publication, transformation and public communication (as well as making it available to the public) of the image (and/or name) for any media, including but not limited to print, audio, digital, press, radio, Internet, social networks and other media. This authorisation covers the use of name and image of the winner for any purpose in connection with this Sweepstakes (be it commercial, al or otherwise) in any media, whether analogue or digital, including use in any media for the entire world, free of charge.
How to enter
5.1 To enter, navigate the Internet to spainispartofyou.spain.info/uk/ (the “Sweepstakes Website”) and follow all instructions to complete and submit the entry form (“Registration Form”).
5.2 Limit one (1) entry per valid e-mail address. Multiple entries in excess of this limitation or mass entry attempts will result in disqualification of all entries by such person. Entries must be manually key-stroked by the entrant; use of automated entry devices or programs, or entries by third parties, are prohibited. Incomplete entries will not be accepted. Proof of entering information at the Sweepstakes Website or entry form is not considered proof of delivery or receipt of such entry.
Prize
6.1 The prize consists of a 4 days-3 nights trip to Granada (Spain) (hereinafter, “the Prize”) valued at 4.500€ for the winner and one (1) guest, including the following:
Return flights to Granada, economy class. Departure from London or Manchester airport.
Three nights in Granada in a 4-star or superior category hotel, in a standard double room and breakfast included.
Transfer from Granada airport to the hotel and vice versa.
Two dinners, one with a flamenco show.
Private Panoramic Tour of Granada with driver and English-speaking guide including the Alhambra and a visit to the Generalife.
Day trip to Malaga (includes transport, lunch and guided tour).
Experiential activity in Granada: Arab bath.
6.2 The winner must take the trip between September 1, 2018 and December 31, 2018. If winner is unable to take the trip within this time, he/she will be disqualified, will forfeit the Prize in its entirely, without compensation of any kind.
6.3 Once travel is booked, travel dates cannot be changed. All expenses not specifically mentioned herein are not included and are solely the winner’s responsibility, including but not limited to: meals, round trip transportation between the winner’s residence and any Airport of Origin, activities and ground transportation not expressly included in the Trip, excess luggage fees, gratuities, insurance, laundry service, merchandise, parking, room service, service charges, souvenirs, spa services, telephone calls and some additional taxes which are not expressly included in the Trip. Any difference between stated value and actual value will not be awarded. Hotel regulations and conditions apply. Certain restrictions, as determined by Sponsor, and black-out dates may apply. Any picture identification requirements associated with air travel are the Prize winner and guest responsibility. Travel arrangements must be made through a Travel Agency of the Sponsor´s choice. Flight details are subject to availability and airline carrier’s regulations and conditions apply. Released Parties (as defined in rule section 9) are not responsible for lost or mutilated tickets and none will be replaced. The hotel accommodations and airline tickets will be determined at the sole discretion of Sponsor.
6.4 The Sponsor reserves the right to change the Prizes for other prizes of equal value if there is a reasonable cause for this.
6.5 To the fullest extent permitted by the applicable law, the Sponsor will not be responsible for any negligent or wrongful use of the Prize by the winner.
6.6 The Prize is subject to these Terms and Conditions and cannot be replaced by cash. The Prize shall not be subject to change, alteration or compensation at the request of the participants in the Sweepstakes. If the winning participant declines the Prize, he/she will not be offered any alternative gift.
6.7 The Prize is personal and non-transferable. The sale or commercialization of the Prize is strictly forbidden.
6.8 To the fullest extent permitted by the applicable law, the Sponsor is not responsible for any losses or delays caused by any interruption, temporary lack of availability or continuity of operation, transmission problems, loss of information, fraud, malfunction in the network, software malfunction, access failure, communication or response or alteration of the Sweepstakes due to technical problems or any other problems beyond the Sponsor’s control.
6.9 The Sponsor will not be held responsible if it is unable to inform the winner that he/she has won because the email address registered on the form in the Sweepstakes website is incorrect or incomplete, or because the email address provided is not consulted by the winner, or it has been removed or is configured so that emails sent by the Sponsor are classified as spam.
Winner selection and notification
7.1 The winner and 20 subtitutes will be selected in a random drawing by computer from among all eligible entries received during the Sweepstakes Period. The draw will take place within 2 weeks after the sweepstakes period is finished.
7.2 The Spanish Tourist Office in London will contact the winner at the email address included in the Registration Form to communicate to him/her that they have won, to confirm that the conditions of participation have been complied with and to request the necessary information and documentation to present them with the Prize.
7.3 In the event that a participant does not meet all the provisions of these Terms and Conditions or that, after having made three (3) attempts to contact the participant in different business days at different times, the participant cannot be located, the Sponsor will automatically reject his/her participation, without further notice, and will proceed to contact the first chosen substitute. In case the substitute does not meet all the provisions of these Terms and Conditions or in case that, after three (3) attempts to contact the substitute in different business days at different times, the substitute could not be located, the Sponsor will reject his/her participation and will proceed to contact the second chosen substitute and so forth.
7.4 The name of the winner who has accepted the prize will be published on the Sweepstakes Website within 15 days from the date of the winner acceptance.
General Conditions
8.1 The Sponsor reserves the right to modify, suspend, shorten the Sweepstakes Registration Period or cancel the Sweepstakes or draw if there is a reasonable cause for this, or if there are not enough participants and to make any necessary decisions regarding the Sweepstakes (unless prohibited by local law). Any suspension, cancellation or modification will be announced in the Sweepstakes Webpage.
8.2 Facebook does not sponsor, endorse or manage this Sweepstakes in any way, nor is it associated with it and is merely a conduit for the Sweepstakes´ dissemination.
8.3 The winner is solely responsible for determining and paying all national and / or local taxes applicable.
8.4 Should any incident occur during the Sweepstakes Registration Period, the participants may contact the Customer Service email address at spainispartofyou@gmail.com.
8.5.- Once the winner has accepted the Prize, all the travel details will be managed through the Travel Agency selected by the Sponsor, duly notified by written. The Travel Agency will be responsible for the trip, according to the legal regulations applicable.
Limitations of Liability By participating, each participant agrees: (a) to be bound by these Terms and Conditions and the decisions of the Sponsor; and (b) to release, discharge and hold harmless Sponsor, each of their respective advertising and agencies and prize suppliers, any entity responsible for the administration of this Sweepstakes, each of the foregoing entities’ respective parent, subsidiary, related, affiliated and successor companies, and each of their respective officers, directors, agents, representatives and employees (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage, including, without limitation, death and bodily injury, arising in any manner, directly or indirectly, in whole or in part, from participation in this Sweepstakes or any Sweepstakes -related activity, and/or from entrant’s acceptance, receipt, use or misuse of the prize or component thereof (including without limitation, any failure to pay taxes thereon).
Data Protection
10.1 Person responsible for the processing: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter, GDPR), applicable from 25 May 2018, establishes the obligation to appoint a Data Protection Officer at any public sector authority or body that processes personal data. By clicking on the “I accept” button (or equivalent) incorporated into the form(s), you declare that the information and data you have provided in them are accurate and true. Any change to the data provided must be communicated to TURESPAÑA as soon as possible, via the following email address: cdatos@minetad.es.
10.3 Rights of the interested parties: We inform you that you can exercise the following rights:
I. right of access to your personal data to know which data are being handled, as well as the processing operations carried out with them;
II. right to rectify any inaccurate personal data;
III. right to delete your personal data, whenever possible;
IV. right to request the limitation of the processing of your personal data when the accuracy, legality or necessity of the processing of the data is doubtful, in which case, we may keep the data for the exercising or defending of claims.
V. right to the portability of your data.
VI. right to revoke the consent granted to TURESPAÑA.
You can exercise the rights listed above at any time and free of charge, by sending an email to cdatos@minetad.es, attaching a copy of your ID or equivalent document, and stating what right you wish to exercise, and an address for notification purposes. On the other hand, we inform you that you have the right to file a claim with the Spanish Data Protection Agency if you consider that there has been a breach of the legislation on data protection regarding the processing of your personal data.
Applicable legislation Unless prohibited by law, all issues and questions concerning the construction, validity and enforceability of these Terms and Conditions, or the rights and obligations of the participant and TURESPAÑA regarding the Sweepstakes, shall be governed by and construed in accordance with the Spanish common law, omitting any rules on conflicto of laws or choice of law that would require applying the laws of any other place. Unless prohibited by law, the courts of the city of Madrid shall have exclusive jurisdiction to resolve any disputes, claims and lawsuits arising from or in connection with this Sweepstakes.
